These Website Terms of Use (the “Terms”) govern your access to and use of the Freedom Waters Foundation website (the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. About Freedom Waters Foundation

Freedom Waters Foundation (“FWF,” “we,” “us,” or “our”) is a Florida nonprofit organization recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code.

2. Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted on the Site. Your continued use of the Site after changes are posted means you accept the updated Terms.

3. Eligibility

The Site is intended for users 13 years of age or older. If you are under 13, you may not use the Site or submit personal information through it. If you are a parent or guardian and believe a child under 13 has provided personal information to us, please contact us so we can address it.

4. Privacy

Your use of the Site is also subject to our Privacy Policy, which explains how we collect, use, and share information. By using the Site, you consent to our data practices as described in the Privacy Policy.

5. Intellectual Property

All content on the Site—such as text, images, photographs, graphics, videos, logos, designs, and other materials (collectively, “Content”)—is owned by or licensed to FWF and is protected by intellectual property laws.

Permission to use Content:
You may view, download, and print Content only for personal, non-commercial use, provided you do not remove any copyright, trademark, or other proprietary notices.

Restrictions:
Unless we expressly authorize it in writing, you may not:

• Copy, reproduce, republish, upload, post, transmit, distribute, modify, create derivative works from, or publicly display Content for commercial purposes
• Use our name, logos, or trademarks without prior written permission
• Frame, mirror, or otherwise incorporate any portion of the Site into another website or service without prior written consent

6. Acceptable Use

You agree to use the Site lawfully and responsibly.

You may not:

• Use the Site in any way that violates applicable law or regulation
• Attempt to gain unauthorized access to the Site, other user accounts, or related systems
• Interfere with or disrupt the Site (including by introducing malware, viruses, worms, or harmful code)

We may investigate suspected violations and may suspend or terminate access to the Site at our discretion.

• If you submit or upload content to us through the Site or otherwise (including testimonials, stories, comments, photos, videos, or other materials) (“User Content”), you represent that:
• You own the rights to the User Content or have permission to submit it; and
• Your submission does not violate any third-party rights (privacy, publicity, copyright, trademark, etc.).

Unless we agree otherwise in writing, by submitting User Content you grant FWF a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, publish, display, perform, distribute, modify (for formatting/clarity), and create derivative works from that User Content for FWF purposes, including marketing, program awareness, and fundraising, in any media.

If you do not want your name, likeness, or submitted materials used publicly, do not submit them (or clearly state your limitations when submitting, and we will make reasonable efforts to honor them).

8. Donations and Payments

The Site may allow you to donate or pay fees (for example, event registration) through third-party payment processors. When you donate or submit payment information, you represent you are authorized to use the payment method provided and that the information you supply is accurate.

Donation policy:

• Donations are generally final and non-refundable unless otherwise stated in writing for a specific campaign or event.
• You are responsible for any fees charged by your bank, card issuer, or payment provider.
• We do not provide tax, legal, or financial advice. Please consult your own advisor regarding deductibility and other tax matters.

9. Program Participation and Safety

Information on the Site about programs, outings, or events is for general informational purposes. Participation in FWF programs may requires separate waivers/releases, media releases, and adherence to safety rules. Those additional terms (when applicable) will apply to participants and may be provided during the sign-up process.

10. Third-Party Links

The Site may contain links to websites or services operated by third parties. These links are provided for convenience only. FWF does not control third-party sites and is not responsible for their content, practices, or policies. Your use of third-party sites is at your own risk and subject to their terms.

11. Disclaimer of Warranties

The Site and Content are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, FWF disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that:

• The Site will be uninterrupted, secure, or error-free
• Content will be accurate, complete, or current
• The Site or servers are free from viruses or other harmful components

12. Limitation of Liability

To the fullest extent permitted by law, FWF (and its directors, officers, employees, volunteers, agents, and affiliates) will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to:

• Your use of (or inability to use) the Site
• Your reliance on any Content
• Any third-party links or services
• Unauthorized access to or alteration of your transmissions or data

If a court determines FWF is liable despite these Terms, FWF’s liability will be limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless FWF and its directors, officers, employees, volunteers, agents, and affiliates from any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use or misuse of the Site
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

14. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or if we decide to discontinue the Site or any portion of it.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site must be brought in state or federal courts located in Florida, and you consent to personal jurisdiction there.

16. Miscellaneous

• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Entire Agreement: These Terms (and any policies referenced, including the Privacy Policy) are the entire agreement between you and FWF regarding the Site.
• No Waiver: Failure to enforce any provision is not a waiver of our right to enforce it later.
